1. Requested Information

(a.) City of Newton Information Systems End-User interaction with the following uniform resource locators (URL) during 15 NOV 2019 at 0001 Local Time through 27 NOV 2021 at 2359 Local Time:

(b.) The existence of any of the following uniform resource locators (URL) or their subdomains within the City of Newton’s information systems network usage logs.

(c) The existence of any of the following uniform resource locators (URL) or their subdomains within the City of Newton’s information systems network usage logs that are not associated with City of Newton User accounts.

(d.) End User information evidence shows accessed the above uniform resource locators (URL) or their sub-domains.

(e.) 2. City of Newton, Iowa Local Policy regarding Employee Conduct and use of City Information System Assets

(a.) 2020 City of Newton Employee Handbook – Section 3.1 Electronic Communications and Internet Use

“No City employee, including temporary employees, shall request, use, or permit the
use of any publicly owned property, vehicle, equipment, labor, service or supplies
(new, surplus, scrapped or obsolete) for the personal convenience or advantages of
the employee or any other person except for that use which is generally available to
the public.”

(c.) Newton, Iowa City Administrative Manual – 1-7 – Internet and Electronic Mail Acceptable Use

“This procedure replaces the previous procedure 1-7 dated September 16, 1999.

The purpose of this Procedure is to set forth the basic guidelines regarding employee use of the Internet and electronic mail software.

Applicability

This Procedure is applicable to all employees. Certain exceptions may be applicable within the confines of Library usage as it pertains to Library-specific law or policy with regard to patron confidentiality. This may need a case-by-case analysis if necessary.

In General

Internet access and electronic mail use can provide significant business benefit to the City of Newton. The efficient use of these tools can improve the quality and productivity of the services the City provides to its citizens. Department Directors can authorize Internet access for employees having a legitimate need for the tool (e.g. research, communication, resource sharing, etc.).

Internet access is a privilege, not a right. Internet access and e-mail shall not be used for any illegal, improper, unprofessional or illicit purpose. The use of these tools is for business purposes.

Those laws and Administrative Policies that govern and guide employee behavior, communication and business practices in all facets of work also apply to the manner in which Internet access and e-mail is used. Persons conducting business on the Internet are representing the City of Newton. Therefore, all actions and communications should be conducted in a manner that is consistent with the behavior that is expected of employees of the City of Newton.

Under the Iowa Open Records Act (Code of Iowa Chapter 22) and the Freedom of Information Act as interpreted by the federal courts, e-mail and electronic files obtained via the internet are public records and subject to inspection by the public in the same manner that paper document of a similar nature are preserved and made available. Certain rules promulgated by the Library pursuant to state laws regarding public internet usage may supersede this policy.

Internet Access

1) Department Directors are responsible for authorizing internet access for his/her respective employees.

2) Employees authorized to have Internet access will sign a statement agreeing to abide by this Internet and Electronic Mail Acceptable Use procedure before such access is given.

3) The City reserves the right to monitor staff use of the Internet. Inappropriate use of the Internet will at a minimum result in the loss of the privilege. Inappropriate use includes but is not limited to the following activities:

a) Any traffic that violates state/local and Federal laws

b) Any traffic that is unethical in nature

c) Distribution of unsolicited advertising

d) Propagation of computer worms and/or viruses

e) Distribution of chain letters

f) Sexually offensive materials

Any and all material downloaded from the Internet shall be downloaded to an external storage device, and/or scanned for viruses by an in-place program before saved to the City’s network. If a program is downloaded, the user is responsible for checking copyright or licensing agreements. Users may accept licensing agreements and pay registration fees only with authorization from his/her Department Director.

Electronic Mail (e-mail)

1) E-mail is intended for business use.

2) The City prohibits the use of electronic mail in ways that are disruptive, offensive to others, or harmful to morale. E-mail may not be used to solicit others for commercial ventures, religious or political causes, outside organizations, or other non-business matters.

3) E-mail and electronic files are the property of the City. Retention of e-mail messages and files electronically transmitted, as an attachment to an e-mail message should utilize the same standard as a paper copy of the transmission would and the city’s record retention policy.

4) The City reserves the right to monitor e-mail messages. Messages transmitted to or from any workstation via e-mail are neither private nor confidential.”

5. Purpose of Request

Phoenix Harbor (phoenixharbor.com) is a site/personal blog of creative writing regarding theology, philosophy, fictional writing (regarding the human experience), romantic poetry, erotic writing (with corresponding explicit imagery of BDSM, bondage, and other sexual themes that adhere to the terms of service (TOS) of the utilized hosting company), etc. Illusory Abuse (phoenixharbor.com/illusory-abuse) is a subsite of Phoenix Harbor (phoenixharbor.com) that includes an in-progress and incomplete archive of legal documents produced by the Respondent of San Diego East County Court Case: ED100465. All contents of Phoenix Harbor (phoenixharbor.com) are protected by the 1st Amendment to the Constitution of the United States of America. All published legal documents regarding San Diego East County Court Case: ED100465 adhere to the requirements of California Family Code 166(a)(7)
