The Form of Iowa Justice

Iowa Attorney General Brenna Bird:

On 12 APR 2023, Jasper County, IA Sheriff’s Office Reserve Deputy Ryan Eaton falsely accused me of stalking (See: Iowa Code Section 708.11) Jasper County, IA employees, and spousal abuse in an email he sent to Jasper County, IA Attorney Scott Nicholson. Jasper County, IA, Sheriff Halferty would later acknowledge that Ryan Eaton’s allegation that I stalked Jasper County, IA employees had no merit. San Diego East County Superior Court case: ED100465, the San Diego County Sheriff’s Office, and the United States Navy have all documented there is zero evidence supporting that I abused my ex-wife Claudia J. Bergman or any of my children.

Iowa Code Section 708.7(1.)(a.)(4.) states that it is a criminal act if someone “Reports or causes to be reported false information to a law enforcement authority implicating another in some criminal activity, knowing that the information is false, or reports the alleged occurrence of a criminal act, knowing the act did not occur.” 

I respectfully request an answer to two questions:

​Is the State of Iowa a place that uniformly enforces our laws in accordance with the evidence, or does the State of Iowa only file charges when the evidence of a violation of our laws is against those society has already determined are undesirable?

Iowa Code Section 802.4 stipulates that this alleged criminal act remains within the limitations of our laws until one year after the commission of the alleged crime.

The evidence indicates what separates me from Jasper County, IA Attorney Scott Nicholson, Jasper County, IA Sheriff’s Office Reserve Deputy Ryan Eaton, City of Newton, IA Attorney Matthew Brick, City of Newton, IA Chief of Police Robert Burdess, and the Iowa Public Information Board is that I have evidence of numerous statewide alleged infractions of our laws. At the same time, the evidence indicates they only have words that are not supported by evidence and historical acts that have produced evidence supporting a logical motive regarding why they have falsely accused or participated in the attempted criminalization of my life.

I respectfully submit on this 4th day of April 2024, Iowa Attorney General Bird, are you going to ensure the law is enforced in the State of Iowa, or are you simply going to continue endorsing political candidates that have numerous indictments against them while you work to control women’s reproductive rights?

As the historical evidence shows that it has been customary for me to close my correspondence with a comedic reference, I would like to respectfully submit that I believe it is so easy to find evidence supporting the service-connected mental health disability discrimination and other acts of Iowa government body abuse I have experienced since honorably retiring from the United States Navy an Iowa Republican could do it.

The historical record of evidence shows that upon my presentation of evidence in late 2021 through early 2022 to Jasper County, IA Attorney Scott Nicholson regarding his alleged gender-based discrimination regarding his handling of a domestic abuse restraining order violation in 2019, his office began silencing me on social media through social media blocks while he sought reelection in 2022, and attempts to criminalize me through defamatory rhetoric that evidence in the form of public records indicates originate from his office.

The evidence supporting the State of Iowa’s class-based justice system is well represented regarding the conduct that has been executed against me, which I have reported to the State of Iowa. At the same time, the evidence shows that the State of Iowa has disregarded these reports. In contrast, the evidence indicates the alleged public servants that I have reported have continued to attempt on numerous occasions to criminalize and build prejudice against me, my investigation, and my complaints.
